A quick note before the legal terms

Before the full terms below, here are a few things we want to call out directly.

If you are viewing a space

The 2D and 3D spaces on Smplrspace are created by the people and organizations who use our platform. We do not endorse or guarantee the dimensional accuracy of any space we host, and we do not verify that a model is drawn to scale. For questions about a specific space, please reach out to the provider who created it. Smplrspace should never be the sole basis for renovation, construction, life-safety, or emergency planning.

If you have an account

• Fair usage. Every feature and plan is subject to fair usage. If your usage falls outside our pricing model, we will reach out to find a resolution, and where needed we may limit features or close the account. Abuse of these terms may lead to suspension.
• Sandbox is for testing. Sandbox spaces are for evaluation and prototyping only. They carry a "Sandbox — not for production use" label. Please do not use them in production, and do not remove or hide that label.
• Keep the attribution. Spaces you publish or embed show a "Powered by Smplrspace" attribution. Unless you hold a white-label license, please keep it visible and unaltered. White labeling is available — just reach out.
• No workarounds. Please do not try to circumvent the usage, attribution, or accuracy safeguards built into the platform.

Additional terms specific to Smplrspace

These additional terms form part of, and should be read together with, the Terms and Conditions below. Where they conflict with the Terms and Conditions, these additional terms prevail.

Your content and data

You retain all ownership of, and all intellectual property rights in, the spaces, models, floor plans, data, and other content you create or upload to Smplrspace ("Customer Content"). We claim no ownership of it. You grant Smplrspace a non-exclusive, worldwide license to host, store, process, reproduce, and display Customer Content solely as necessary to operate and provide the service to you, including making it available to the users and viewers you authorize. We may engage service providers to help deliver the service under equivalent obligations. This license lasts only while your Customer Content is on the platform; it ends when you delete the content or close your account, except for residual copies kept in routine backups for a limited period or as required by law. We will not sell your Customer Content, and we will not use it for unrelated purposes.

Personal data you upload

Where your Customer Content includes personal data about your own users — for example employees, occupants, or visitors — you act as the controller and Smplrspace acts as your processor. We process that data only to provide the service and on your instructions, under our data processing agreement.

Accuracy of spaces

Smplrspace does not warrant the dimensional accuracy of any space, model, or measurement made available through the service, and does not verify that any model is a to-scale representation of the physical space it depicts. The service is a visualization and data tool. It must not be relied upon as the sole basis for renovation, construction, structural, life-safety, evacuation, or emergency-planning decisions, and you remain responsible for independently verifying any measurement before relying on it. To the maximum extent permitted by law, Smplrspace is not liable for any loss, damage, or injury arising from reliance on the dimensional accuracy or completeness of any space, model, or measurement.

Sandbox spaces

Sandbox spaces are provided for evaluation, prototyping, and testing only. They display a "Sandbox — not for production use" label. You must not use Sandbox spaces in any production environment, and you must not remove, hide, obscure, or otherwise tamper with that label.
